Conditions of Sale

The Website www.jantelting.com  and its Merchandises for to sale is owned by Quintus Jan Telting Family Foundation-Holland (Christine Telting) and Art Management Joachim Mentzel & Wolfgang Keller, Luitpoldstr. 48, D-91052 Erlangen - Germany. Further here named „The Q.Jan Telting Foundation“

The following conditions apply to the use of the Web Site and the purchase of any item displayed on the Web Site Quintus Jan Telting and of the Art Work of Quintus Jan Telting.

1. Images of the Art Work

The Buyer agree that the images of the Art Works on the Website (the ‘Website Images’) are guidelines only. The Q.Jan Telting Foundation will accept no responsibility for differences between the Website Images and the actual Art Work Q.Jan Telting.

2. Formation of Contract

2.1 A binding contract shall be formed upon receipt by The Buyer of a confirmation e-mail from The Q.Jan Telting Foundation acknowledging The Buyer´s order. This is an effective acceptance which will be deemed complete and will be deemed for all purposes to have been effectively communicated to The Buyer at the time The Q.Jan Telting Foundation sends the e-mail to The Buyer.

2.2 At the discretion of The Q.Jan Telting Foundation, alternative methods of forming a binding contract may be negotiated.

2.3 Any binding contract is between The Buyer and The Q.Jan Telting Foundation of the relevant Art Work Q.Jan Telting. Further details of the Art Work will be sent to The Buyer in the confirmatory email.

2.4  Process of purchasing

The process of purchasing is very simple: As The Buyer  please click on our contact link form and inform us with the chosen Art Work. Please fill all form fields and then click Send button to email the completed form to our address.

Upon receipt of an/this email with your Art Work order, we contact you to confirm all by phone or email. Based upon the data submitted by you, we prepare information on cost of the order of Art Work, date and other terms of delivery maid by several alternative methods.

Then, we will send you an email containing information on mode of payment and necessary details.

Upon receipt of the specified amount of money to our account, we send or deliver you the purchased Art Work. The purchased goods will be sent to any of the addresses specified by The Buyer.

3. Payment

3.1 Payment for all works herein shall be in Euros for the advertised price of Art Works. The Buyer shall make payment to The Q.Jan Telting Foundation with money wiring to following bank account:

3.2 Alternative methods of payment may be used with special agreements at the direction of the The Q.Jan Telting Foundation.

4. Delivery and Insurance

4.1 All art purchase deliveries and shipments are from The Q.Jan Telting Foundation to The Buyer. Delivery services for the Art Works done through The Q.Jan Telting Foundation and paid from The Buyer. The Q.Jan Telting Foundation takes no responsibility for other delivery services.

4.2 Delivery costs including insurance and will be additional to the original price of the Art Work.

4.3 Every Art Work is packed by hand in strong materials and then carefully transported. Thus, The Buyer may be absolutely sure that The Buyers purchase will be delivered undamaged within specified terms. The Buyer purchase shipment will be made within 48 hours from the moment the money is received by The Q.Jan Telting Foundation.

5. Refunds and Return Policy

5.1 The Buyer must notify The Q.Jan Telting Foundation within five (5) days from the date of receipt of the Art Work by e-mail to info@jantelting.com of any intended return. After this time, all sales are final. The Buyer may return any Art Work acquired for full credit against the purchase of any other Art Work available at same value or for a complete refund, provided that:

(a) Returns of Art Work from The Buyer shall be to The Q.Jan Telting Foundation upon receipt of The Buyer´s email by The Q.Jan Telting Foundation. Details of the return address will be sent to The Buyer by email.

(b) The Art Work shall be returned in same condition received and within 7 (7) days from the date of notification of such return.

5.2 The Buyer is responsible for return delivery and shipping costs.

5.3 The Q.Jan Telting Foundation may be entitled to make a charge not exceeding the direct costs of recovering any Art Work supplied where The Buyer does not return the Art Work after cancellation of the contract or The Buyer does so at The Q.Jan Telting Foundation´s expense.

5.4 There is no right to return the Art Work where the Art Work have been made to your specifications or have been personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

6. The Q.Jan Telting Foundation

6.1 All dealings are subject to the consent of The Q.Jan Telting Foundation .

6.2 The Q.Jan Telting Foundation warrants that he/she created and possesses unencumbered title to all Art Work under the Terms and Conditions of Sale. Title to the Art Work will transfer to The Buyer´s upon possession.

6.3 Unless otherwise specifically indicated, the Art Work are originals, executed by The Q.Jan Telting Foundation and are certified to be free from all defects due to faulty craftsmanship or faulty materials for a period of twelve months from the date of sale by The Q.Jan Telting Foundation.

6.4 If flaws should appear during this period and be due to such causes, the Art Work shall be subject to repair or replacement, at the option of The Q.Jan Telting Foundation. The Buyer is cautioned, however, that The Q.Jan Telting Foundation cannot be responsible for fading, cracking, and other damage to these works caused by improvident exposure to sunlight and weather.

7. The Art Management

7.1 The Art Managements relationship to The Q.Jan Telting Foundation is advertiser and sales executive for the purpose of selling Q.Jan Telting Art Work consigned to the Art Management.

7.2 After the five (5) day approval period, The Buyer accepts the underlying Art Work, relieving the Art Management of all responsibility. Any future claims due to undiscovered faults, hidden defects or questions of authenticity lie solely between the The Q.Jan Telting Foundation and The Buyer.

7.3 The Art Management and The Q.Jan Telting Foundation reserves the right to refuse service to anyone at any time.

8. Transactions

The Q.Jan Telting Foundation operates on a first-come basis, with all orders for Art Work to be sent via the Website. The customer, who notifies The Q.Jan Telting Foundation of an intention to buy a particular Art Work, shall have first rights to purchase. In the event that two or more customers have interest in the same Art Work, determination of which customer came first will be determined by the time and date of the order.

9. Dispute Resolution

If any dispute arises between The Buyer and/or The Q.Jan Telting Foundation and/or the Art Management The Buyer agree to attempt to settle it by negotiation. A party may not serve an ADR notice or commence court proceedings/an arbitration until 21 days after it has made a written offer to the other party(ies) to negotiate a settlement to the dispute.

10. Copyright in the Art  Work and in the Web Site

10.1

(a) The Q.Jan Telting Foundation reserves all rights and copyright legislation in all Art Work purchased by The Buyer.

(b) The sale of the underlying work does not include the sale of rights to reproduction in any form unless specifically granted in writing by The Q.Jan Telting Foundation. Copyright sales are wholly The Q.Jan Telting Foundations privilege and an entirely separate transaction and not part of the underlying sale of the Art Work.

(a) All intellectual property contained on the Website including design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software and all other material on this Website are to remain the property of the The Q.Jan Telting Foundation.

(b) Images of the Art Work are scanned by permission granted by The Q.Jan Telting Foundation for the purposes of advertisement for sale. These images may only be copied or saved, or otherwise reproduced, from The Q.Jan Telting Foundations website for The Buyers consideration to purchase. Copying, saving or otherwise reproducing these images for any other purpose is strictly prohibited.

11. Governing Law

11.1 The contract will be deemed to be formed in Holland or Germany and shall be interpreted, construed and enforced in all respects in accordance with the laws of these countries.

11.2 The Buyer agree to irrevocably submit to the jurisdiction of these Courts.

12. Notice

The Q.Jan Telting Foundation reserves the right to revise the Terms and Conditions of Sale. Revisions will be dated and supersede previous Terms and Conditions of Sale.

Private Policy

The Q.Jan Telting Foundation fully understands how important information secrecy is for each of our customers and partners. Thus, our main target is full secrecy and protection of The Buyers information. The Q.Jan Telting Foundation will never use any obtained information commercially, share or sell it to any third parties. The Q.Jan Telting Foundations main goal is ensuring maximum comfort to our customer, and therefore The Buyer may be absolutely sure that The Q.Jan Telting Foundation shall provide complete information secrecy. The Q.Jan Telting Foundation makes everything possible and takes all necessary steps to protect The Buyers information against disclosure, alteration and unauthorized access.
